Acceptance of Terms: By accessing and using the Heliport Safety Organization’s Electronic Landing-zone System (ELS) ("the Software"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Software.

Description of Service: The Heliport Safety Organization (HSO) provides the Electronic Landing-zone System (ELS), a centralized database for managing helicopter/eVTOL landing area and procedural information.

ELS Data: The ELS integrates information from the following sources. This data is displayed as is, and the HSO is not responsible for its accuracy and validity:

  • Federal Aviation Administration (FAA): Public heliport records from the FAA’s Airport Data and Information Portal (ADIP) are uploaded through the National Airspace System Resources (NASR) on a 28-day cycle.
  • Heliport data supplied by heliport owners.
  • Heliport, landing zone, facility, and user waypoints data supplied by helicopter operators.
  • Heliport landing zone data based on satellite imagery.

Intellectual Property: All content, trademarks, and data on the Software, including software, text, graphics, logos, and images, are the property of the Heliport Safety Organization or its licensors and are protected by intellectual property laws.

Hold Harmless: In consideration of the permission granted to report hazards and use the ELS, users agree to hold harmless, indemnify, and defend the Heliport Safety Organization, its directors, officers, employees, agents, and individuals who furnish the information from and against any and all claims, liabilities, losses, damages, expenses (including reasonable attorneys' fees), and causes of action arising out of or in connection with any incorrect or inaccurate data or hazard reporting that results in an incident or accident. Users acknowledge that hazard reporting involves inherent risks and uncertainties and agree that the Heliport Safety Organization shall not be liable for any errors, inaccuracies, or omissions in the reported data, or for any decisions made or actions taken based on such data. Users further agree to assume full responsibility for any consequences resulting from the use or reliance on the furnished data and the reported hazards.

Limitation of Liability: To the fullest extent permitted by law, the Heliport Safety Organization shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Termination: We reserve the right to terminate or suspend your access to the Software at any time, without prior notice or liability, for any reason, including breach of these Terms.

Governing Law: These Terms shall be governed and construed in accordance with the laws of Arizona, without regard to its conflict of law provisions.

Changes to Terms: We reserve the right to modify or replace these Terms at our sole discretion. If a revision is material, we will provide at least 30 days’ notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.
